It would appear that District Attorney David Soares is giving it the ol’ college try…again. You may remember his name as being the Albany District Attorney who arrested the owners of Signature Pharmacy, then had the case dismissed before it saw the inside of a court room. The words “epic fail” come to mind…

Well, Soares is back to his old tricks, and he’s trying desperately to get this case to trial, despite the fact that he is now a defendant in a civil case brought on his entire office by Signature Pharmacy.

Although Judge Stephen Herrick originally dismissed the indictments,  2010 decision by the appeals court ruled the prosecutors could ask another grand jury for a new indictments. So, once again, criminal charges have been filed against the Loomis family: husband and wife, Robert “Stan” Loomis and Naomi Loomis, and Michael Loomis (Robert’s’ brother). Also charged were Kirk Calvert (Signature’s former business manager) and Anthony Palladino (a former manager).

This time, they were all charged with enterprise corruption, several counts of felony drug sale, and attempted drug sale as well as conspiracy charges.

All five were released on bail, with their lawyer offering the following assessment of the situation:

“We expect this indictment to suffer the same fate as the previous indictment. It will be dismissed,”

Of course, what he didn’t say is that this would be the second time David Soares will be embarrassed on a national stage, for failing to get a conviction in the biggest case of his life.
